| 内容記述 | While studying whether universal basic income is compatible with the Constitution, it is necessary to clarify the legal nature of the “obligation to work” under Article 27. The purpose of this study is to propose a new classification of theories on this obligation. While prior research has covered the subject, I will attempt to add a new perspective. For this perspective, I will highlight the normative nature of the Constitution and the obligation of the nation state. Furthermore, I will apply a “strict constitutional interpretive theory” to the question of constitutionality. Consequently, I hope to clarify several questions surrounding the “obligation to work” and enrich the legal study of universal basic income. |
