| 内容記述 | Using physical restraints in hospitals or long-term care facilities is prohibited by the law in Japan.In this way,physical restraints means physically hold as “hard restraints" is prohibited. But physical restraints are not only body control. Watching and beholding care for patients are “soft restraints" and invading them. Physical restraints is prohibited but on occasions of emergency allowable use by the way of exception. If it was legality, but also it was justify in ethical approach. In thesis, we will make a study if it could be this however ethical argument on the ground that. | |||||

| 内容記述 | 本邦では医療施設や介護施設において、身体拘束は法的に禁止されている。ここで禁止されているのは物理的に拘束する「ハードな拘束」である。しかし、抑制するだけが拘束ではない。観察や見守りなどのケアも「ソフトな拘束」であり、侵襲である。拘束は禁止されているが、緊急時には例外として認められている。法的に正当化されるとしても倫理的に正当化することはできるのだろうか。もしできるとすれば、どのような倫理学的な理論が根拠になりうるのか検討する。 | |||||
