| 内容記述 | 子どもの権利条約第９条第３項による親から分離された子どもの面会交流の意義が、分離された親の権利のみならず特に子どもの権利であることを強調する。別居親の父親からの申立て事案から、子どもの最善の利益を考慮して検討する。 その際に、子どもの意見表明権を重視する制度を義務付けることを提案する。 |

| 内容記述 | This paper emphasizes that the significance of visitation for children separated from their parents according to Article 9, paragraph 3 of the Convention on the Rights of the Child is, first and foremost ,the right of the child itself. It is neither the right of the separated parent nor the right of the custodial parent. The discussion examines the best interests of the child by studying the petition filed by the separated father. In doing so, we propose to mandate a system that emphasizes the child’s right to express their opinion. |
